Agreement to terms

These Terms of Use constitute a legally binding agreement between you and glow-fern Ltd ("we", "our", or "us") regarding your use of our services and website. By accessing our website or using our services, you accept and agree to be bound by these terms.

If you do not agree with these terms, you must not use our services or access our website.

Scope of services

We provide fitness training, coaching, and nutrition services including:

  • One-to-one personal training
  • Small-group fitness classes
  • Nutrition coaching and guidance
  • Online training programmes
  • Technique workshops and seminars

The specific services available to you depend on the package or membership you have purchased.

Health and safety

Medical clearance

Before commencing training, you must disclose any medical conditions, injuries, or health concerns that could affect your ability to exercise safely. You agree to:

  • Provide accurate and complete health information during your initial assessment
  • Inform us immediately of any changes to your health status
  • Obtain medical clearance before training if you have certain conditions or if we request it
  • Follow medical advice regarding exercise and activity levels

If you fail to disclose relevant health information and this leads to injury, we cannot accept liability.

Assumption of risk

Physical training involves inherent risks including muscle soreness, fatigue, and in rare cases, more serious injury. By using our services, you acknowledge and accept these risks.

While we take reasonable precautions to minimise risk through proper instruction and supervision, we cannot guarantee that injuries will not occur. You participate in all activities at your own risk.

Your responsibilities

During training sessions, you agree to:

  • Follow instructions provided by coaches
  • Inform coaches immediately if you feel pain, discomfort, or unwell
  • Use equipment safely and as instructed
  • Not train under the influence of alcohol or recreational drugs
  • Wear appropriate clothing and footwear
  • Respect other members and maintain appropriate behaviour

Booking and cancellation

Personal training sessions

Personal training sessions must be booked in advance. To cancel or reschedule without penalty, you must provide at least 24 hours notice. Cancellations with less than 24 hours notice will result in forfeiture of that session.

We reserve the right to cancel sessions due to coach illness or other unavoidable circumstances. In such cases, we will offer a rescheduled session or credit.

Group classes

Group classes must be booked in advance through our booking system. Class sizes are limited to ensure coaching quality. Cancellations must be made at least 3 hours before the class start time to avoid being charged for the session.

Late arrival

If you arrive more than 10 minutes late to a personal training session or group class, we may refuse entry to avoid disrupting other participants. Late arrivals do not entitle you to a refund or rescheduled session.

Payment terms

Pricing and packages

All prices are displayed on our website and are subject to change. Prices are inclusive of VAT where applicable. We will honour the price quoted at the time of purchase.

Personal training packages must be paid in full at the time of purchase. Monthly memberships are charged automatically on the same date each month.

Payment methods

We accept payment by credit card, debit card, and bank transfer. All payments are processed securely through our payment provider.

Refunds

Personal training packages are non-refundable once purchased. However, unused sessions do not expire within the stated validity period, allowing you to use them at your convenience.

Monthly memberships can be cancelled with one month's written notice. No refunds are provided for partial months.

If you are unable to train due to injury or medical condition, we may offer a membership freeze of up to three months per year. Personal training packages may be extended beyond their normal validity period in exceptional circumstances at our discretion.

Failed payments

If a monthly membership payment fails, we will attempt to collect payment again within 7 days. If payment cannot be collected, your membership will be suspended until the outstanding amount is paid. Continued non-payment may result in termination of your membership and loss of any pre-booked sessions.

Memberships and packages

Monthly memberships

Monthly memberships renew automatically unless cancelled with one month's written notice. Notice must be provided via email to [email protected].

Membership benefits are personal to you and cannot be transferred to another person.

Package validity

Personal training packages have stated validity periods (typically 3-12 months depending on package size). Sessions must be used within this period or they will expire.

Class passes are valid for 3 months from date of purchase.

Membership freezing

You may freeze your monthly membership for up to 3 months per year for reasons such as illness, injury, or extended travel. Freeze requests must be made in writing at least 7 days before your next payment date.

Facility rules

Access and security

You may only access our facility during your scheduled sessions or at times we have agreed. You must not allow non-members to enter the facility.

Use of equipment

Equipment must be used properly and returned to storage after use. If you damage equipment through misuse or negligence, you may be liable for repair or replacement costs.

Personal belongings

We provide lockers for storing personal belongings during sessions. We are not responsible for loss or damage to personal property. Do not bring valuable items to the facility.

Conduct expectations

We maintain a respectful and supportive environment. Behaviour that is aggressive, discriminatory, or disruptive will not be tolerated. We reserve the right to terminate the membership of anyone who breaches our conduct standards without refund.

Intellectual property

All content on our website and in our programmes, including text, graphics, logos, and training materials, is owned by glow-fern Ltd and protected by intellectual property laws.

You may not reproduce, distribute, or create derivative works from our content without written permission. Training programmes provided to you are for your personal use only and must not be shared with others or published.

Privacy and data protection

We collect and process personal data in accordance with our Privacy Policy and applicable data protection laws. By using our services, you consent to such processing.

Progress photographs and performance data will only be used for your training records unless you provide separate consent for other uses such as promotional materials.

Limitation of liability

To the fullest extent permitted by law:

  • We do not exclude liability for death or personal injury caused by our negligence
  • We do not exclude liability for fraud or fraudulent misrepresentation
  • We do not exclude any liability that cannot be limited or excluded by law

Subject to the above:

  • We are not liable for injuries resulting from your failure to disclose health conditions, follow instructions, or exercise within your capabilities
  • Our total liability for any claim is limited to the amount you paid for services in the 12 months preceding the claim
  • We are not liable for indirect, consequential, or economic losses

Insurance

We maintain professional indemnity insurance and public liability insurance as required for our business. Details are available upon request.

We strongly recommend that you maintain personal accident and health insurance to cover any training-related injuries or medical issues.

Disclaimers

Not medical advice

Information and guidance provided by our coaches is for fitness and training purposes only. It does not constitute medical advice and should not replace consultation with qualified medical professionals.

Nutrition coaching provides general guidance on healthy eating to support training. It is not a substitute for medical nutrition therapy for clinical conditions.

Results disclaimer

Individual results from training vary depending on numerous factors including genetics, consistency, nutrition, sleep, and pre-existing fitness level. We cannot guarantee specific outcomes or results.

Changes to services and terms

We reserve the right to modify our services, prices, and these terms at any time. Material changes will be communicated to active clients via email at least 30 days in advance.

Continued use of our services after changes take effect constitutes acceptance of the modified terms.

Termination

We may terminate your access to our services immediately if you:

  • Breach these terms in a serious or repeated manner
  • Behave in a way that endangers safety or wellbeing of others
  • Fail to pay for services
  • Provide false or misleading information

Upon termination, you must immediately cease using our facilities and services. No refunds will be provided for terminations due to breach of terms.

Complaints and disputes

If you have a complaint about our services, please contact us at [email protected]. We will investigate and respond within 14 days.

If we cannot resolve a dispute through discussion, both parties agree to attempt mediation before pursuing legal action.

Governing law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Entire agreement

These terms, together with our Privacy Policy and any additional terms agreed in writing, constitute the entire agreement between you and glow-fern Ltd regarding use of our services.
